Does Colombia have an inheritance tax?

Colombia does not have a separate inheritance tax, but inheritances, legacies and gifts are treated as a ganancia ocasional (occasional gain) and taxed at a flat 10%. Specific UVT-based exemptions reduce the taxable amount depending on the asset and the beneficiary.

How it works

An inheritance is taxed as a ganancia ocasional at 10% on the value above the applicable exemption. The exemption depends on what is received and by whom:

  • The deceased’s home passing to heirs — exempt up to 3,490 UVT.
  • Other inherited assets — exempt up to 1,625 UVT.
  • A legacy or gift to a non-heir (someone who is not a forced heir) — 20% of the value is exempt, capped at 2,290 UVT.

UVT (Unidad de Valor Tributario) is Colombia’s indexed tax unit; the calculator converts each UVT exemption into pesos using the current UVT value you supply.

Example and notes

An heir inherits the family home valued at COP 250,000,000. With a 3,490 UVT home exemption worth roughly COP 164m at recent UVT values, about COP 86m is taxable, and at 10% the tax is around COP 8.6m.

If the same value were a legacy to a friend (a non-heir), 20% of COP 250m (capped at 2,290 UVT) would be exempt — roughly COP 50m — leaving COP 200m taxable and COP 20m of tax. Exemptions are shared where several heirs inherit one asset, so confirm the split with a notario.
