How it works
New York law pays time-and-a-half for hours over 40 in a workweek. The calculation is:
regular_hours = min(hours, 40)
overtime_hours = max(hours - 40, 0)
gross = regular_hours * rate + overtime_hours * rate * 1.5
The NYC minimum is $16.00/hr, so overtime is $24.00/hr. For tipped food-service workers, the employer can pay a cash wage of $10.65 and claim a $5.35 tip credit — but combined cash + tips must reach at least $16.00/hr, or the employer owes the shortfall.
Example and notes
A worker doing 45 hours at $16.00: 40 regular hours = $640, plus 5 overtime hours at $24.00 = $120, for $760 gross that week. A tipped server on the $10.65 cash wage still must net at least $16.00/hr once tips are added. Figures are gross, before tax, for guidance only — not legal or payroll advice.
